Participant Agreement
Please read carefully before your trip.
Liability Release, Assumption of Risk,
and Media Consent Agreement
This agreement must be read and acknowledged by all participants prior to participating in any guided fly fishing trip with On the Fly Adventures.
1. Activity
In consideration of being permitted to participate in a Guided Fly Fishing Trip provided by On the Fly Adventures (the "Guide"), the undersigned ("Angler") agrees to the terms of this agreement.
2. Assumption of Risk
Angler acknowledges that the Activity involves inherent risks, including but not limited to, physical injury, drowning, equipment failure, weather conditions, or encounters with wildlife. Angler acknowledges that they are voluntarily participating in these activities with knowledge of the dangers involved and hereby agrees to accept any and all risks of property damage, personal injury, or death.
3. Release of Liability
Angler, for themselves and their heirs, executors, and assigns, hereby releases, waives, and forever discharges the Guide, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by the Angler while participating in the Activity, whether caused by the negligence of the Guide or otherwise.
4. Indemnification
Angler agrees to indemnify and hold harmless the Guide from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to Angler's participation in the Activity, whether caused by the negligence of the Angler or otherwise.
5. Medical Treatment
Angler acknowledges the need for medical treatment and hereby consents to any medical care, including emergency transport, that may be provided to them as a result of injury or illness while participating in the Activity. Angler agrees to be financially responsible for any costs incurred as a result of such treatment.
6. Media Consent
Angler grants the Guide the unrestricted right to use, publish, exhibit, and distribute photographs, videos, or audio recordings of the Angler taken during the Guided Fly Fishing Trip for any lawful purpose, including marketing, social media, and website content. Angler waives any right to inspect or approve the finished products and waives any right to compensation or royalties. Angler releases the Guide from all claims arising out of the use of their likeness.
7. Governing Law
This Agreement shall be construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
